Terms of Service

Last updated: October 16, 2026

These Terms of Service (the “Terms”) govern access to and use of Phonevoice: the web application at phonevoice.ai, its API and every related feature (together, the “Service”). They form a contract between Osmove and the business that creates an account or uses the Service (the “Customer”, “you”). By creating an account, ticking the acceptance box or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

1. Publisher

The Service is published and operated by Osmove, a French SASU (simplified joint-stock company with a single shareholder) registered under number 902 644 970, whose registered office is at 146 avenue Léon Blum, 92160 Antony, France (“Osmove”, “we”, “us”). Phonevoice is the trade name under which Osmove sells the Service.

2. The Service

Phonevoice is software as a service (SaaS) and an API that let businesses handle their business phone calls with AI voice agents. Depending on the features the Customer configures, the Service includes:

  • automated answering and switchboard for inbound calls;
  • phone numbers assigned to the Customer’s account;
  • outbound calls placed by the Customer, from the dashboard, the API or call campaigns, to its own contacts within the limits of section 6;
  • call recording, transcription, summaries and analysis;
  • integrations with the Customer’s tools (CRM, calendars, webhooks).

The Service relies on third-party providers for telephony (carriers) and artificial intelligence (speech recognition, language models, speech synthesis). Features may evolve; we may add, change or remove features, in which case these Terms apply to the Service as it stands.

3. Business customers only

The Service is reserved for professionals: companies, sole traders, associations and public bodies acting for the purposes of their business or activity. It is not offered to consumers. By creating an account, you represent that you act for such purposes and that the person accepting these Terms is authorised to bind the Customer.

You must provide accurate information when signing up and keep it up to date. You are responsible for the confidentiality of your credentials and API keys, and for all activity carried out with them, including by your employees, your own customers or the software into which you integrate our API. Tell us without delay at [email protected] if you suspect unauthorised use.

4. Prices and payment

  • Usage-based pricing, no subscription. Opening an account is free. The Service is billed on usage: the minutes of calls consumed, at the per-minute rates published on our pricing page (for example €0.29 per minute for an inbound call with the managed AI agent), plus, where applicable, the other items listed there (dedicated phone numbers billed per month, SMS, options). Every minute started is billed in full. Prices are shown excluding VAT; VAT is added where applicable. There is no subscription and no minimum commitment.
  • Prepaid balance. Usage is paid from a prepaid balance that you top up by card. Card payments are processed by our payment provider, Stripe; we do not store card numbers. You may enable automatic top-up, in which case your card is charged the amount you chose whenever your balance falls below the threshold you set. When the balance is exhausted, paid features (in particular placing calls) are interrupted until it is topped up, unless a postpaid arrangement has been agreed with us in writing.
  • Price changes. We may change our prices. New prices are published on the pricing page and apply to usage from the date of publication.
  • Invoices. Invoices are available from your account.

5. Your obligations

You use the Service in compliance with these Terms and with all laws that apply to you and to the people you call or who call you, in particular data protection law (GDPR and national laws), consumer protection law, telecommunications regulations and the rules on call recording. You are solely responsible for the content of your agents (instructions, scripts, messages), for the contact lists you import and for the calls placed from your account.

6. Acceptable use and outbound calling policy

Authorised outbound calls. The outbound features (calls placed from the dashboard or the API, call campaigns) may only be used to call people who have given their consent to be called by the Customer, or who are already customers of the Customer, for purposes connected with that relationship: callbacks, appointment booking and reminders, follow-up of a request, order or file, satisfaction surveys of existing customers.

Prohibited uses. It is forbidden to use the Service:

  • for automated mass prospecting, or for unsolicited calls to people who have neither consented nor have a customer relationship with you;
  • to call numbers registered on Bloctel (the French opt-out register for telephone canvassing) or on an equivalent register in another country, unless an exception provided for by law applies;
  • to call outside the days and hours permitted by law. In France, where the rules on telephone canvassing apply (decree no. 2022-1313 of 13 October 2022), calls may only be made Monday to Friday, from 10 am to 1 pm and from 2 pm to 8 pm, never on Saturdays, Sundays or public holidays, and within the frequency limits set by that decree;
  • with purchased, rented or scraped contact lists, or with numbers generated automatically or sequentially;
  • to conceal or falsify the calling number or the identity of the caller;
  • for fraud, phishing, harassment, threats, or deceptive, illegal or discriminatory content;
  • to circumvent the Service’s limits or security measures, or to resell access to the Service without our written agreement.

Transparency towards the people called. The AI agent must introduce itself as an automated assistant (an AI) at the start of each call and must never pass itself off as a human. The Customer must identify itself as the caller and inform the people called, where required by law, that the call is recorded or transcribed. Any person who asks not to be called again must be removed from your lists.

Your compliance responsibility. You remain responsible for complying with the GDPR (lawful basis, information of data subjects, handling of their rights and objections) and with telecommunications and consumer regulations in every country you call. You must be able to prove, on request, the consent or customer relationship on which your calls rely.

Monitoring, suspension and termination. We may, without notice, suspend a campaign, an agent, a phone number or the whole account when we have reasonable grounds to believe that these Terms are being breached, in particular in the event of complaints, reports from carriers or authorities, or abnormal call volumes or patterns. In the event of a serious or repeated breach, we may terminate the account. We keep call logs (numbers called, dates, durations, outcomes, and transcripts where applicable) and may use them to investigate abuse, and provide them to the competent authorities when the law requires it.

7. Personal data

For the personal data contained in your calls, contact lists and agents (phone numbers, voices, transcripts, information exchanged during calls), you act as data controller and Osmove processes this data on your behalf, as a processor, for the sole purpose of providing the Service. For the data of your own account (users, billing), Osmove acts as controller, as described in our Privacy Policy.

Call recordings are automatically deleted 90 days after the call. Customers who need a specific data processing agreement may contact us.

8. Artificial intelligence

Answers, transcripts, summaries and analyses produced by the AI may contain errors or omissions. You are responsible for configuring your agents, checking their behaviour and supervising the decisions you take on the basis of their output. The Service is not an emergency service and must not be relied upon to place or route emergency calls.

9. Intellectual property

Osmove owns the Service, its software, its documentation and its trademarks. You receive a non-exclusive, non-transferable right to use the Service for your business needs while your account is active. You keep all rights to your content (agent instructions, contacts, recordings) and grant us the rights needed to host, process and transmit it to provide the Service.

10. Availability

We make reasonable efforts to keep the Service available and working, but do not guarantee that it will be uninterrupted or error-free, in particular because it depends on telecommunications networks and third-party providers. Maintenance may cause interruptions. A contractual service level (SLA) is only offered under a separately signed enterprise agreement.

11. Liability

Osmove is only liable for direct damage resulting from a breach of its obligations that is proven by the Customer. Osmove is not liable for indirect damage such as loss of revenue, profit, business, customers or data. To the extent permitted by law, Osmove’s total liability under these Terms is limited to the amounts paid by the Customer for the Service during the twelve (12) months preceding the event giving rise to the claim.

The Customer shall indemnify Osmove against any claim, penalty or sanction brought by a third party (a person called, a carrier, an authority) resulting from the Customer’s use of the Service in breach of these Terms or of the law, in particular of section 6.

12. Term and termination

These Terms apply for as long as you have an account. You may stop using the Service and close your account at any time by writing to [email protected]. We may close an account in accordance with section 6, or with one month’s notice for any other reason. Amounts due for usage before termination remain payable.

13. Changes to these Terms

We may change these Terms. The version in force is the one published on this page, with its date. We will inform you of any significant change by email or in the application before it takes effect; continuing to use the Service after that date means you accept the new Terms.

14. Governing law and jurisdiction

These Terms are governed by French law. If several language versions exist, the French version prevails. The parties will try to settle any dispute amicably first. Failing that, any dispute relating to the formation, performance or interpretation of these Terms falls under the exclusive jurisdiction of the competent courts within the jurisdiction of the Court of Appeal of Versailles (France), including in the case of multiple defendants or third-party claims.
